Booking Terms & Conditions
1. BACKGROUND
These terms and conditions apply to all Bookings made with us and outline the rights and obligations of both parties. The legal entity you contract with depends on the location of your Adventure and will be confirmed in your booking confirmation. See Section 14 for applicable jurisdiction.
By completing a Booking, you confirm that you have read, understood, and agreed to these terms and conditions, any relevant Privacy Policy, and any other specific terms we bring to your attention (collectively referred to as the Booking Conditions). If you do not agree with any of the Booking Conditions, you must not proceed with the Booking.
We may modify the Booking Conditions at any time, with or without notice. You are responsible for reviewing the Booking Conditions periodically. Continued use of our services and Adventures after any updates constitutes acceptance of the modified terms.
2. OUR SERVICE
MystiPicnic provides an online platform where you can explore and book Adventures, which may be offered by us directly or by Third Party Suppliers. When a Third Party Supplier is involved, we act as an intermediary and their own terms will also apply. We are not responsible for verifying all third-party information and cannot guarantee its accuracy.
3. CONDITIONS AND RESTRICTIONS
3.1. General Conditions
By making a Booking, you confirm that:
You are authorised to act on behalf of your Booking Party.
You have advised them of all relevant conditions.
You are eligible to enter binding contracts.
All information provided is accurate and up to date.
You agree to make and authorise payments as required.
3.2. Special Requests
Requests should be submitted before booking. While we try to accommodate them, we cannot guarantee fulfilment. Lack of fulfilment does not entitle you to compensation or refund.
3.3. Age and Health
Some Adventures have minimum age requirements. Anyone under 18 must be accompanied by an adult. You are responsible for assessing the suitability of Adventures and must notify us of any relevant medical conditions.
3.4. Behaviour
All participants must behave appropriately. Disruptive or dangerous behaviour may result in immediate termination of the Booking without refund.
4. BOOKING AND PAYMENT TERMS
4.1. Availability
Adventures are subject to availability and may be modified or withdrawn before confirmation.
4.2. Payment
You agree to pay the full amount, including any applicable taxes or fees. Accurate billing details are required. Non-payment may result in cancellation.
4.3. Confirmation
Your Booking is only confirmed once you receive a confirmation email. Please check all details and notify us immediately of any issues.
4.4. Price Changes
We reserve the right to correct pricing errors and adjust prices prior to confirmation.
4.5. Payment Authorisation
You authorise MystiPicnic to charge your selected payment method and, where applicable, pay Third Party Suppliers on your behalf.
5. CHANGES AND CANCELLATIONS
5.1. By You
Changes must be submitted in advance. Refunds are only available in accordance with the applicable Change & Cancellation Policy.
5.2. By You
We may make minor or material changes. In the event of a significant change, we will offer options including refund or credit.
5.3. Cancellation by Us
We may cancel for various reasons (e.g., minimum numbers not reached, supplier cancellation, etc.). In such cases, you will receive a full refund or credit.
5.4. Early Termination
If you leave early or miss part of your Adventure, no refund will be provided.
6. COMPLAINTS
6.1. Problems must be reported within 7 days after the Adventure. Provide relevant details, and we will assist where possible, but we are not liable for issues caused by Third Party Suppliers.
6.2. In rare cases where a service becomes unavailable, we expect reasonable cooperation in accepting an alternative. Contact us if unsatisfied.
7. PRIVACY
We collect and process your personal information in accordance with our Privacy Policy and applicable privacy laws. You confirm that you have obtained consent from all members of your Booking Party.
8. OUR LIABILITY
8.1. Risk Acceptance
You acknowledge and accept the inherent risks, including those related to COVID-19. We are not liable for any such risks.
8.2. Disclaimer
We do not guarantee the suitability of an Adventure for any participant. Your participation is at your own discretion.
8.3. Limitation of Liability
Our liability is capped at the greater of €50 or the amount you paid for the relevant Booking, subject to applicable law.
9. OUR LIABILITY
We are not liable for events beyond our control, including but not limited to natural disasters, pandemics, supplier failure, or technical issues.
10. TERMINATION
Provisions concerning liability, warranties, and indemnities survive termination.
11. ENTIRE AGREEMENT
These terms, together with other agreed policies, constitute the entire agreement between you and MystiPicnic.
12. ASSIGNMENT
You may not assign or transfer your Booking without prior written consent. Any attempt to do so is void.
13. DEFINITIONS
Adventure: Any adventure available for purchase from time to time on a Website;
Booking: Any Adventure or package booked through MystiPicnic.
Booking Conditions: the meaning given to that term in paragraph 1.
Booking Party: all the persons on whose behalf a Booking is made.
Change & Cancellation Policy: The policy set out at XXXXX.
Privacy Policy: The policy set out at XXXXX.
Third Party Supplier: Any provider other than MystiPicnic supplying part of an Adventure.
Website: Any website or domain operated by MystiPicnic, including: www.MystiPicnic.fr
14. LEGAL ENTITY & GOVERNING LAW
All Bookings are governed by the laws of the country where the Adventure occurs.
